Thousands of disabled people will receive higher benefits after winning a legal victory over the Government.
People will now get £70 to £90 a week backdated to the day the Upper Tribunal, which included a high court judge on its panel, in March.
The Government believes around 10,000 people will benefit by 2022. The shake up axes rules which said people can carry out tasks unsupervised if it’s ‘unlikely’ they’ll come to harm.
Ms. Sarah Newton MP (Minister for Disabled People) has confirmed that due to the judgement:
*All one and a half million existing PIP claimant will have their PIP awards reviewed to check whether awards should be increased
*Any PIP arrears are only legally payable to the date of the judgement
*Only those claimants whose awards are changed following the review will be contacted to tell them of their new award
*Legal rights of appeal will only attach to those decisions
*All health care professionals have received updated training and guidance to enable them to ensure they are able to correctly assess claimants’ safety
